1.What is the difference between litigation and a no-fault divorce?

Briefly put, litigation involves differences between individuals or parties that cannot be resolved through out-of-court methods such as settlement, mediation or arbitration.These out-of-court options are alternative ways to keep a case from having to go to a court of law. With respect to divorce issues, when a couple cannot resolve differences regarding custody issues, finances, property, etc., then ultimately, the case must go to court and a judge will decide those issues.  A no-fault divorce, on the other hand, involves individuals who have assessed their situation and have pretty well agreed on most of the issues related to custody, finances, property, etc.  With this in mind, they need only complete the legal aspects of their divorce to finalize the dissolution of marriage.  In essence they are saying that their marriage was not successful and neither of them is to blame.

   2.   How do I know if my marriage involves litigation or a no-fault divorce?

Litigation typically involves a costly attorney.  If throughout your marriage, you and your spouse could never agree on anything then you probably would also experience a difficult divorce with the likelihood of an attorney a real necessity.  If your marriage was rather smooth and you and your spouse realize that you have simply grown apart with different needs, then your divorce will probably also be smooth.
